Environmental Safety

A number of regulations have been introduced in the UK to comply with EU directives concerning environmental damage. These regulations implement a ‘polluter pays’ principle, meaning that businesses must take precautionary measures to prevent environmental damage and take remedial actions if damage occurs.

Environmental fines are proportionate to the cost of the damage including the cost of reinstatement, cost of disposing of the waste materials associated with the clean up as well as the enforcing agencies time and effort to bring the case to court. A criminal case will almost always be followed by civil claims for damage to livelihood by all parties impacted by the environmental incident. And that’s before you consider the impact of any negative PR.

  • Review your insurance policies, many businesses mistakenly assume that their existing liability policies will provide cover for any situations that arise as a result of pollution. However, many commercial insurance policies contain exclusions in relation to pollution.
  • Conduct an environmental risk assessment of all your business activities and procedures
  • Consider whether you have an environmental management policy in place? If so, does it address the risks identified in the assessment?
  • Consider whether you have had any environmental incidents/accidents in the last few years? If so what processes/training have you implemented to prevent this from re-occuring?
